These Terms of Service (“Terms”) govern your access to and use of Lume, the self-guided audio walking-tour service available at lume.travel and in the Lume web app (the “Service”). The Service is operated by Oddballtrip LLC, a limited liability company formed under the laws of the State of Wyoming, United States (“Oddballtrip”, “we”, “us”). By purchasing a pass or gift card, or by using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
Lume provides location-aware audio narrations of points of interest within a chosen city, delivered to your own smartphone. A pass grants access to a tour for a defined validity window that begins when you tap activate — not when you pay. You choose your stops (from four to fifteen) and the language; the price is the same regardless of how many stops you choose.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By purchasing, you represent that you can form a binding contract with us.
3. Purchases, pricing & currency
Prices are shown in your displayed currency. Where a fixed local price exists we charge that; otherwise the price is converted from a euro baseline at the exchange rate applied at checkout. The amount shown at checkout is the amount you are charged; applicable taxes, if any, are your responsibility unless stated otherwise. Payments are processed by our payment provider, Stripe; we do not receive or store your full card details.
4. Activation & validity
Each pass carries a validity window that starts at activation and lasts for the period stated at purchase (typically 12 hours). Activation is irreversible and starts the clock immediately. Each activation code is intended for a single device. You are responsible for keeping your code confidential.
5. Delivery & technical requirements
The Service is delivered digitally. Your activation code and link are sent to the email you provide, usually within about 15 minutes of purchase while your tour is finalized. Use of the Service requires a compatible smartphone with GPS and, to download the tour, an internet connection; once downloaded, the walk can be followed offline. We are not responsible for device, network, or GPS limitations outside our control.
6. Gift cards
A gift card is redeemable by the recipient for one city of their choice. Once redeemed and bound to a city, a gift card is treated as a pass and is subject to these Terms. Gift cards are non-refundable once redeemed.
7. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
8. Acceptable use & safety
You agree to use the Service lawfully and with full attention to your physical surroundings. Lume is not a substitute for situational awareness. Cross streets carefully, respect private property and restricted areas, and follow all local laws and customs. You agree not to misuse the Service, reverse-engineer it, resell access, or use it to infringe the rights of others.
9. Intellectual property
The Service, including audio narrations, written text, translations and software, is owned by Oddballtrip or its licensors and is licensed to you for personal, non-commercial use only. Resale, rebroadcast, public performance or redistribution is prohibited. Certain underlying data is drawn from sources such as OpenStreetMap, Wikipedia and Wikimedia Commons under their respective open licenses, with attribution.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by law. Historical and factual claims are researched and sourced but may contain errors or omissions; they are provided for general information and cultural interest only. We do not warrant that the Service will be uninterrupted, error-free, or available in any particular location.
11. Limitation of liability
To the maximum extent permitted by applicable law, Oddballtrip will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on the content or your use of, or inability to use, the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid for the pass giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Oddballtrip from any claim or demand arising out of your breach of these Terms or your misuse of the Service.
13. Changes
We may update the Service and these Terms from time to time. Material changes take effect when the updated Terms are posted here, with a revised “last updated” date. Your continued use after changes constitutes acceptance.
14. Governing law & disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue. If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you mandatory protections, nothing in these Terms deprives you of the mandatory rights available to you under the law of your place of residence.
15. Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
